1. Purpose and acceptance
These terms govern access to and use of the Sutempo service (the “Service”), published by the publisher of Sutempo (“Sutempo”, “we”), by any professional opening a business account (the “Business”, “you”). Together with the privacy policy and thedata processing agreement, they form the entire agreement.
Opening business access constitutes unconditional acceptance of these terms. The Service is exclusively intended for professionals acting in the course of their business; it is not intended for consumers.
End customers booking with a Business are not parties to this agreement: their contractual relationship is with the Business, whose customers they are.
2. Description of the Service
Sutempo is online appointment booking and business management software for businesses and practitioners working by appointment, regardless of profession. It includes, in particular: a public booking page, a calendar, a service catalogue, customer records, automatic emails, a customer portal and, depending on the plan, management of teams, locations, rooms and equipment, group classes, packs and credits, review requests and reports.
Online payments are made to the Business’s Stripe account, connected to Sutempo through Stripe Connect. Sutempo never holds your customers’ funds and charges no commission on your appointments or payments received.
The Service evolves. We may add, change or remove features, provided we do not substantially impair the main use described above without reasonable notice.
3. Account and access
Your Sutempo account is personal. It is created using a verified email address (one-time code), or Google or Apple. Sutempo stores no password. Access to a business (a “business workspace”) is granted by invitation from an administrator of that business or during setup.
You are responsible for keeping your email inbox and Google or Apple accounts secure, as well as for actions taken from your account and access you grant to your team. You must inform us promptly of any unauthorised use.
We may suspend access in the event of a security risk, breach of these terms or legal obligation, after informing you unless the matter is urgent.
4. Plans and prices
Two plans are available, described on the pricing page which forms part of the agreement:
- Solo : free, for one location and one bookable calendar, with unlimited appointments and online payments included.
- Pro : €29 excluding VAT per month, per location; multiple bookable calendars, packs, group sessions, review requests, multiple languages, widget and API.
A Scaleplan, focused on bringing customers back, has been announced but is not on sale: it cannot be subscribed to. Subscriptions taken out under the former Team and Studio names are retained and correspond to Pro and Scale respectively.
Prices exclude taxes; applicable VAT is added to the invoice. Sutempo charges no commission, no fee per team member and no fee on payments received. Your Stripe account fees are payable to Stripe under Stripe’s terms.
We may change prices with 30 days’ notice by email. A price change never applies to a period already paid for. If you do not accept the new price, you may return to Solo or cancel before it takes effect.
5. Trial and billing
You may request a 14-day Pro trial without a payment card, once per business and per owner identified by their email address. A business that has previously had a paid subscription is not eligible. At the end of the trial, without a subscription, your business automatically returns to Solo without losing data; paid-plan features become inaccessible until you subscribe, except for the use of credits already sold to your customers and sessions already scheduled.
Subscriptions are monthly, payable in advance by charging the payment method on file, with no minimum term. The number of billed locations is the number active on the first day of the period. Invoices are available under Settings, Billing.
If a payment fails, we notify you and retry for 14 days; after that, the business returns to Solo. No data is deleted because of non-payment.
6. Right of withdrawal
As the Service is for professionals only, the right of withdrawal under the French Consumer Code does not apply, except where the law extends it to a professional (in particular, in France, a professional employing no more than five employees who enters into an off-premises contract outside the scope of their main business activity). In that case, you have 14 days from subscribing to withdraw by writing to contact@sutempo.com. In practice, the absence of a minimum commitment and the ability to return to Solo at any time make this issue of little consequence.
7. Your customers’ payments
Online payments use your own Stripe account, which you connect to Sutempo. You are the merchant of record: funds are paid into your account, and refunds and disputes are governed by your relationship with Stripe and your customers. You accept Stripe’s terms, including the Stripe Connected Account Agreement.
You freely set your prices, deposits, cancellation terms and refund policies, and ensure they comply with the law applicable to your business and are clearly communicated to your customers. Sutempo displays this information as you enter it.
8. Your obligations
You undertake to:
- use the Service for a lawful business and hold any authorisations, qualifications or approvals required for your profession;
- publish accurate content to which you hold the rights (photos, logos, text), which is not misleading, defamatory or contrary to public policy;
- inform your customers transparently about your services, prices and terms, and meet your own legal obligations to them, particularly regarding data protection (you are the controller of their data and Sutempo is your processor);
- send through Sutempo only emails relating to appointments or for which you have a lawful basis; review requests and communications that are not strictly transactional must respect your customers’ consent;
- not attempt to bypass security measures, access other businesses’ data, overload the Service or extract data in bulk other than through the provided exports.
We may remove clearly unlawful content or suspend a reported public page, informing you when we do so.
9. Your data
The data you enter and your customers’ data belong to you. You can export your customers in CSV format and the data available in reports at any time from the administration area.
We process it on your behalf under thedata processing agreement, and do not use it for advertising or sell it to third parties. Aggregated, anonymised statistics may be used to improve the Service.
You can permanently delete your business under Settings, Account and security, Delete this business. Deletion is immediate and covers all of the business’s data, as described in the privacy policy. Remember to export anything you must retain beforehand, particularly for accounting obligations.
10. Availability, maintenance and support
We use our best efforts to keep the Service continuously available. Interruptions may occur for maintenance, updates or reasons beyond our control (hosting, network, payment or email providers). Wherever possible, planned maintenance takes place outside businesses’ usual opening hours and is announced in advance.
Support is provided by email at contact@sutempo.com, in French, English and Spanish, on working days.
11. Liability
Sutempo is a tool: you remain solely responsible for running your business, your services, managing your calendar and your relationships with customers. We are not a party to agreements between you and your customers.
We are liable only for a proven breach of our obligations, and only for direct damage. Our total liability for all causes in a year is capped at the amount you paid us in the twelve months preceding the event giving rise to the claim, and at €100 for a business on the Solo plan. We are not liable for lost revenue, customers or data resulting from misuse, failure to export before deletion, or the failure of a third party (Stripe, Google, Apple, email provider, hosting provider).
Nothing in these terms excludes liability that cannot be limited under applicable law.
12. Intellectual property
Sutempo, its brands, interface and code remain the property of the publisher of Sutempo. You have a personal, non-exclusive, non-transferable right to use the Service for the term of the agreement. Solely to provide the Service, you grant us the right to host and display content you publish.
13. Term, suspension and termination
The agreement takes effect when the account is opened and continues without a minimum term. You may return to Solo at any time (paid features end at the end of the paid period) or delete your business.
We may terminate the agreement with 30 days’ notice by email, or without notice for a serious breach (fraud, unlawful content, security breach, persistent non-payment after reminders). In all cases, you have access to your exports and your data is deleted in accordance with the privacy policy.
If we decided to discontinue the Service, we would inform you at least 90 days in advance to allow you to export your data.
14. Changes to the terms
We may amend these terms. Any material change is notified by email at least 30 days before taking effect. Continued use after that date constitutes acceptance; otherwise, you may cancel without charge.
15. Governing law and disputes
The agreement is governed by French law. If a dispute arises, we first seek an amicable solution: write to us at contact@sutempo.com, and we will reply within 15 days. If no agreement is reached, the dispute falls within the jurisdiction of the competent courts for the publisher’s registered office, unless a mandatory provision requires otherwise.
If you are a professional benefiting from consumer law protections, you may use a consumer mediator under the conditions provided by law.
